We are engaged by counsel, and the engagement can be structured to support privilege. Whether privilege applies is a question for your attorney; we will work within the structure they set.

Do you work directly for the parties or for attorneys?

Litigation engagements are structured through counsel. If you are an owner in a dispute and do not yet have an attorney, we can talk about what that looks like.

Can you act as a consulting expert rather than a testifying expert?

Yes. Many engagements start with consulting work to test the financial theory of the case before anyone decides whether to designate a testifying expert.

Can you review the other side’s expert report?

Yes. Rebuttal analysis is a common engagement: we test the assumptions, the data and the math behind the opposing numbers.
